Terms of Service

These terms are the agreement between you and Misimi Corp for using Jralo. Please read section 5: it says plainly what Jralo does not do.

1. Who we are

Jralo (the "Service", at jralo.com) is operated by Misimi Corp, GNB Road, Guwahati, Assam 781007, India ("we", "us"). Contact: support@jralo.com.

2. Business use only

The Service is offered to businesses and professionals. By accepting these terms you confirm that you are at least 18, that you use the Service for business purposes and not as a consumer, and, if you accept for an organisation, that you may bind it ("you").

3. The agreement

These terms, the Acceptable Use Policy, the Refund Policy, the Data Processing Addendum where it applies, and, where you use them, the Badge Terms and Directory Terms form the whole agreement between you and us. If you do not agree, do not use the Service.

4. What the Service does

  • Checks. Jralo runs automated tests on public web pages against selected success criteria of the Web Content Accessibility Guidelines (WCAG), and website quality checks such as broken links, page errors, broken images and slow pages, and reports what it found.
  • Evidence record. For signed-in accounts, each check is written into a dated, tamper-evident record for that site.
  • Website Mechanic. If you connect a GitHub repository, Website Mechanic uses artificial intelligence to write fixes for the problems the latest check found and opens a pull request for you to review. It reads only the repositories you choose, it opens pull requests only, and it never merges anything.
  • Badge and directory. On a paid plan you may choose to publish a public record of your site's checks, show the Monitored by Jralo badge, and be listed in the public directory.

5. Important limits

  • Automated testing is partial. Automated tools find some accessibility issues, not all. Many WCAG criteria need human judgement. A result showing no issues does not mean a page has none.
  • No finding of legal compliance. The Service does not determine, certify or guarantee that any website meets WCAG, the Americans with Disabilities Act, the European Accessibility Act or any other law or standard. We never issue certificates.
  • Not legal advice. We are not a law firm. Nothing in the Service, including the country guides, the badge and the public record, is legal advice or a substitute for advice from a qualified lawyer.
  • No protection from claims. Using the Service, showing the badge or being listed in the directory does not prevent, and we do not promise to prevent, any demand letter, complaint, lawsuit, investigation or penalty.
  • Suggested fixes may be wrong. Explanations and code changes, including those Website Mechanic writes, may be incomplete, incorrect or unsuitable for your site. You are responsible for reviewing, testing and merging any change.

6. Your responsibilities

You will: (a) check in detail only websites you own or are authorised to test; (b) connect Website Mechanic only to repositories you control; (c) keep your account secure; (d) follow the Acceptable Use Policy and the laws that apply to you; (e) make your own decisions about your website and take your own legal advice; and (f) keep your own backups of your website and code.

7. Free checks

Free checks are limited in pages and in how often they can be run. We may change or withdraw them at any time.

8. Plans, payment and renewal

Paid plans and fix cycles are sold through our reseller and Merchant of Record, Creem, which takes payment, issues invoices and collects any tax due. Creem's buyer terms also apply to your purchase. Subscriptions renew automatically for the same period until cancelled. You can cancel at any time from Manage billing in your dashboard; you keep the plan until the end of the period already paid for. Prices may change on 30 days' notice, from your next renewal. Refunds and fix cycles are covered by the Refund Policy.

9. Website Mechanic

  • A fix cycle fixes what your latest check found and opens one pull request. A run that opens no pull request is not charged: the cycle goes back to your wallet. Fix cycles do not expire.
  • To write a fix, your repository's code is processed by our AI provider, which is named in the Privacy Policy. We do not keep your code after the job finishes.

10. Your data

You keep all rights in your websites, your code and the results about your sites ("Your Data"). You give us a limited licence to use Your Data only to provide, secure and improve the Service, including showing the public record you choose to publish. Personal data is handled as set out in the Privacy Policy and, where it applies, the Data Processing Addendum.

11. Our commitments on data

We are bound by the commitments on our Responsible use page. In particular, we never sell or share check results about any site, never give lists of sites, issues or scores to law firms, plaintiffs or data brokers, and publish nothing about a site except the record its owner chose to make public, which never lists issues or scores.

12. Our intellectual property

We own the Service, its software, explanations, badge designs and report formats. While you follow these terms you may use the Service and the reports it produces for your internal business purposes. If you send us feedback, we may use it without obligation to you.

13. Third-party components

The Service uses open-source software, including axe-core (Mozilla Public License 2.0), and the third-party services listed in the Privacy Policy. Their licence terms apply to those components.

14. Confidentiality

Each party will keep the other's non-public information confidential and use it only for this agreement, except where the law requires disclosure.

15. Disclaimer of warranties

To the maximum extent permitted by law, the Service, the badge, the public record and all results, explanations and suggested changes are provided "as is" and "as available", without warranties of any kind, whether express, implied or statutory, including warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, or that any website will meet any law or standard or avoid any claim.

16. Limitation of liability

To the maximum extent permitted by law: (a) neither party is liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, goodwill or data, or for any settlement, judgment, penalty or legal fees relating to the accessibility of your website; and (b) our total liability arising out of or relating to the Service is limited to the greater of the fees you paid in the 12 months before the event giving rise to the claim and USD 100. These limits do not apply to liability for fraud, wilful misconduct, your payment obligations, your breach of the Acceptable Use Policy, or your indemnity obligations, or to any liability that cannot be limited by law.

17. Your indemnity

You will defend and indemnify us against third-party claims, losses and costs (including reasonable legal fees) arising from: (a) your websites, including their accessibility; (b) your use of the Service, the badge or the directory in breach of these terms; (c) checking a website, or connecting a repository, that you were not authorised to use; or (d) changes you merge into your own code.

18. Suspension and termination

We may suspend or end your access, or remove a badge or directory listing, at once if you breach the Acceptable Use Policy, the Badge Terms or the Directory Terms, fail to pay, or create legal or security risk for us or others. You may stop using the Service at any time and delete your account from the dashboard, which deletes your data as described in the Privacy Policy. Sections 5, 10 to 17, 20 and 21 continue after termination.

19. Changes

We may update these terms. For material changes we will give at least 30 days' notice by email or in the Service. If you do not agree, you may cancel before the change takes effect.

20. Governing law and disputes

These terms are governed by the laws of India. Any dispute arising out of or relating to them will be resolved by arbitration under the Arbitration and Conciliation Act, 1996, by a sole arbitrator appointed by agreement of the parties or, failing agreement, under that Act. The seat and venue of arbitration is Guwahati, Assam, India, and the language is English. Either party may seek urgent interim relief from a competent court. Subject to the arbitration agreement, the courts at Guwahati have exclusive jurisdiction. Nothing in this section removes a right that the law of your country gives you and that cannot be waived by contract.

21. General

You may not assign these terms without our written consent; we may assign them to a successor of the Service. Neither party is liable for delay caused by events beyond its reasonable control. If a provision is found unenforceable, the rest stays in effect. Not enforcing a provision is not a waiver. Notices to us go to support@jralo.com; notices to you go to your account email.
